Release and Waiver of Liability Annual Moonlight Pond Tour

This Release and Waiver of Liability (the “Agreement”) is made and entered into as of the date of ticket purchase by the purchaser of the ticket (the “Participant”).

WHEREAS, Nature’s Re-Creations ( the “Organization”) is hosting its Annual Moonlight Pond Tour (the “Event”); and

WHEREAS, the Participant desires to participate in the Event; and

WHEREAS, the Organization requires all participants to execute this Agreement as a condition of participating in the Event.

NOW, THEREFORE, in consideration of the opportunity to participate in the Event, the Participant agrees as follows:

Assumption of Risk: The Participant acknowledges that participating in the Event involves certain inherent risks, including but not limited to:

Walking on uneven or slippery surfaces, especially in low-light conditions.

Falling into or near ponds or other water features.

Contact with plants, insects, or other wildlife.

The possibility of accidents or injuries while traversing the tour route.

Transportation to and from tour locations (if applicable).

The Participant voluntarily assumes all such risks and any other risks associated with participating in the Event.

Release of Liability: The Participant, for themselves, their heirs, executors, administrators, and assigns, hereby releases, waives, and discharges the Organization, its officers, directors, employees, volunteers, agents, and representatives (collectively, the “Released Parties”) from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by the Participant, or to any property belonging to the Participant, whether caused by the negligence of the Released Parties or otherwise, while participating in the Event or while on the premises where the Event is being conducted.

Indemnification: The Participant agrees to indemnify and hold harmless the Released Parties from any loss, liability, damage, or cost, including reasonable attorney’s fees, that they may incur due to the Participant’s participation in the Event, whether caused by the negligence of the Released Parties or otherwise.

Medical Treatment: The Participant authorizes the Organization to seek and administer emergency medical treatment if necessary. The Participant agrees to be responsible for all costs associated with such treatment.

Photography Release: The Participant grants the Organization permission to use any photographs, videos, or other media taken of the Participant during the Event for promotional or other purposes, without compensation.

Severability: If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the State of Missouri.

Entire Agreement: This Agreement constitutes the entire agreement between the parties and supersedes all prior agreements or understandings, whether written or oral.

BY ACKNOWLEDGING THE PURCHASE OF THIS TICKET, THE PARTICIPANT ACKNOWLEDGES THAT THEY HAVE READ THIS AGREEMENT, UNDERSTAND ITS CONTENTS, AND VOLUNTARILY AGREE TO ITS TERMS AND CONDITIONS.
