Agreement Between User And PartyFixx.co
The PartyFixx.co website (the “Site”) is comprised of various web pages and is fully controlled and operated by PartyFixx, LLC. (“PartyFixx” or “us”). By accessing and using this Site, you are hereby agreeing to be legally bound by the terms and conditions of PartyFixx, LLC. (the “Agreement”). Please note that this Site and the Services (as defined below) offered are only open to users 13 years of age or older. If you do not agree with all of the following terms and conditions, please do not use this Site. PartyFixx.co Is An Online Marketing And Ticket E-Commerce Site.
PartyFixx.co provides users with a central guide for all the hottest events during big party weekends and in a city near you. Visitors can browse events, as well as purchase tickets to events. Event organizers can submit their event for posting for free, or for a charge if they would like to list their event in the “Featured Party Weekend” area of the website (i.e.: NBA All Star, Super Bowl, Fight Weekend, CIAA, etc).

Ownership of Intellectual Property
All site software, design, text, images, photographs, illustrations, audio clips, video clips, artwork, graphic material, or other copyrightable elements, and the selection and arrangements thereof, and trademarks, service marks and trade names (the “Material”) are the property of PartyFixx, LLC. and/or its subsidiaries, affiliates or assigns or PartyFixx, LLC.’s licensers or other respective owners and are protected, without limitation, pursuant to U.S. and foreign copyright, trademark and other applicable laws. PartyFixx, LLC. hereby grants you a personal, non-exclusive, non-assignable and non-transferable license to use and display the Material for noncommercial and personal use only provided that you maintain all copyright and other notices contained in such Material. You agree not to reproduce, modify, create derivative works from, display, perform, publish, distribute, disseminate, broadcast or circulate any Material to any third party (including, without limitation, the display and distribution of the Material via a third party website) without the express prior written consent of PartyFixx, LLC.. Use of PartyFixx, LLC. and/or its licenser’ material is only permitted with their express written permission. You further agree that you will not disassemble, decompile, reverse engineer or otherwise modify the Material. Any unauthorized or prohibited use may subject the offender to civil liability and criminal prosecution under applicable federal and state laws.

Indemnification And Limitation Of Liability
You agree to indemnify, defend and hold harmless, PartyFixx, LLC., its affiliates, and their respective officers, directors, employees, agents, licensors, representatives, and third party providers to the Site from and against all losses, expenses, damages and costs, including reasonable attorneys’ fees, resulting from any violation of this Agreement by you. PartyFixx, LLC. reserves the right to assume, at its sole expense, the exclusive defense and control of any matter subject to indemnification by you, in which event you will fully cooperate with PartyFixx, LLC. in asserting any available defenses.

In no event will we or our event providers, suppliers, advertisers and sponsors, be responsible or liable to you or anyone else for, and you hereby knowingly and expressly waive all rights to seek, direct, indirect, special or consequential damages of any type other than out of pocket expenses, and any rights to have damages multiplied or otherwise increased, arising out of or in connection with the site, the content, or any product or service purchased through the site, even if we have been advised of the possibility of such damages, and regardless of whether the claim is based upon any contract, tort, or other legal or equitable theory.

Electronic Communications
Visiting PartyFixx.co or sending emails to PartyFixx.co constitutes electronic communications. You consent to receive electronic communications and you agree that all agreements, notices, disclosures and other communications that we provide to you electronically, via email and on the Site, satisfy any legal requirement that such communications be in writing.

Your Account
If you use PartyFixx.co, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. You may not assign or otherwise transfer your account to any other person or entity. You acknowledge that PartyFixx.co is not responsible for third party access to your account that results from theft or misappropriation of your account. Ticket Refund Policy
What happens if there are issues getting into the event?
If you encounter any issues at the event, you must contact PartyFixx within 5 days following the originally scheduled date of the event via a trouble ticket inquiry at info@partyfixx.co in order to request a refund. Failure to do so will waive your right to a refund. Not all refund requests will be honored.

What if I can’t make the event can I get a refund for my ticket?
All sales are final. Refunds are only given if an event is canceled or rescheduled.

The event I purchased a ticket for was canceled or rescheduled can I get a refund?
If an event is canceled you will receive a refund minus the nonrefundable service charge. If the event is rescheduled you will have the option of a refund minus the service charge or tickets to the rescheduled date.

PartyFixx.co may contain links to other websites (“Linked Sites”). The Linked Sites are not under the control of PartyFixx.co and PartyFixx.co is not responsible for the contents of any Linked Site, including without limitation any link contained in a Linked Site, or any changes or updates to a Linked Site. PartyFixx.co is providing these links to you only as a convenience, and the inclusion of any link does not imply endorsement by PartyFixx.co of the site or any association with its operators.

Certain services made available via PartyFixx.co are delivered by third party sites and organizations. Miscellaneous
PartyFixx, LLC. operates and controls this site from its offices in Dallas, Texas, United States of America. This site is intended exclusively for residents of the United States including residents of the United States, its territories and possessions. No software from this Site may be downloaded, exported or re-exported in violation of any law including, without limitation, to countries that are subject to U.S. export restrictions. This Agreement contains the entire understanding and supersedes all prior understanding of the parties hereto relating to the subject matter hereof, and cannot be changed or terminated orally. If any provision of this Agreement is found to be illegal or unenforceable, the Agreement will be deemed curtailed to the extent necessary to make it legal and enforceable and will remain, as modified, in full force and effect.
