I wish to participate in the ALL IN Tour Activity at the purchase location, and hereby assume all risks of engaging in the Activity. I also hereby hold harmless and release Love Life Accessories, Team Bling It On, its members, managers, owners, employees, contractors and agents, as well as Robin Frank & Michelle Egan in their individual capacity (collectively, “Indemnitees”) and indemnify each of them from and against any and all loss, claim, cause of action, lawsuit, damage, liability, cost or expense whatsoever which any of them may incur arising out of or in connection with my participation in the Activity at the Location, including but not limited to: all travel (in whatever form) to, from and/or during the Activity; all programs, excursions, meetings, gatherings conducted as part of the Activity; meals, food and beverages served at the Location; and the use of facilities at the Location.

I hereby certify that I am at least 18 years of age (or, if less than 18 years of age, have caused this Liability Waiver and Release to be signed by my parent or legal guardian), I agree that neither I nor any member of my family will sue any Indemnitee because of my participation in the Activity or my presence at the Location at any time, and I understand that this Release shall be binding upon my estate, my heirs, next of kin, executors, administrators, representatives, successors and assigns. I specifically waive any claim or right to assert any cause of action or alleged case of action or claim or demand which has, through oversight or error intentionally or unintentionally or through a mutual mistake, been omitted from this Liability Waiver and Release.

I further agree:

• to pay in full at or before the commencement of the Activity all fees, charges and expenses charged by Love Life Accessories and Team Bling It On for the Activity;

• to pay in full before the end of the Activity all charges and expenses that I have incurred while a guest at the Location;

• to obey all rules developed by Love Life Accessories and Team Bling It On for the Activity as well as the rules, regulations and staff of Love Life Accessories and Team Bling It On, and agree that I may be removed from participation in the Activity and asked to leave the Location at any time for any reason that Love Life Accessories’ and/or Team Bling It On’s staff deems adequate;

• to be financially responsible for any and all damage that I may cause while at the Location, including but not limited to light fixtures, walls, windows, doors, and cars, it being understood that my right to use the Location may be terminated permanently at the sole discretion of Love Life Accessories, Team Bling It On and/or the Location if I commit any illegal and/or violent acts while on the Location premises whether intentionally or negligently;

• not to use narcotic substances of any kind or overindulge in alcoholic beverages while participating in the Activity and/or at the Location, it being understood that my right to participate in the Activity and stay at the Location may be terminated permanently at the sole discretion of Love Life Accessories, Team Bling It On and/or the Location if I am found to be under the influence of any alcoholic beverages or narcotic substances while on the Location premises;

• to assign irrevocably to Love Life Accessories and Team Bling It On all rights to my likeness and voice in any photo or video of me taken while I am at the Location and/or participating in the Activity;

• to allow Love Life Accessories and Team Bling It On to use my name, likeness, image, voice, the city and state of my residence, and biographical and other information concerning me in any such photo or video, in any printed, online or other media now known or hereafter discovered, without compensation, obligation or liability to me of any kind whatsoever.

· the transfer of communicable diseases or viruses, including Covid 19 and other viruses like the flu, is an inherent and assumed risk in the participation of an event. You are required to take their own personal precautions by wearing a mask and social distancing.

This Liability Waiver and Release shall be governed by the laws of the State of Utah, and any action, claim or proceeding under this Liability Waiver and Release shall be commenced exclusively in Salt Lake County, UT or the United States District Court for the Middle District of Utah. This Liability Waiver and Release may not be revoked, terminated or amended verbally, but only by a written instrument signed by me and an authorized representative of Love Life Accessories and/or Bling It On. All covenants contained herein are severable, and in the event of any being held invalid by any competent court, this Agreement shall remain intact except for the omission of the invalid covenant. The prevailing party in any action to enforce this Agreement is entitled to recover all attorney’s fees and costs incurred.

I HAVE READ AND UNDERSTAND THIS LIABILITY WAIVER AND RELEASE AND AM AWARE THAT BY PURCHASING THIS TICKET, I AM WAIVING CERTAIN LEGAL RIGHTS WHICH I OR MEMBERS OF MY FAMILY, MY HEIRS, NEXT OF KIND, EXECUTORS, ADMINISTRATORS, REPRESENTATIVES, SUCCESSORS AND ASSIGNS MAY HAVE AGAINST INDEMNITEES.
